What Is AIPRA? A Brief History

Before 2004, the inheritance of allotted Indian trust land was governed by a patchwork of tribal codes, state laws, and federal regulations that created enormous confusion — and an ever-worsening ownership problem known as fractionation.

The American Indian Probate Reform Act of 2004 (AIPRA, 25 U.S.C. § 2201 et seq.) was Congress's attempt to bring order to this chaos. AIPRA created a uniform federal probate code that applies to the inheritance of trust and restricted land for most federally recognized tribes. It established default rules for what happens when a Native American landowner dies without a will — and it set strict requirements for what a valid will covering trust land must contain.

Trust Land vs. Fee Land: Two Completely Different Legal Worlds

Lineal descendants (children, grandchildren)
Parents
Siblings

Probate of trust land is handled by the Office of Hearings and Appeals (OHA) within the Department of Interior, not by state courts. An administrative law judge issues a probate order. This process can take years and offers fewer procedural protections than a typical court proceeding.

Tribal Court Jurisdiction vs. State Court

For fee land and other assets (bank accounts, personal property, cars), the decedent's state of residence generally governs. State probate courts have jurisdiction, and a standard state-law will applies.

For trust land, federal law and the OHA probate process govern. Some tribes have received authorization to handle their own probate proceedings under tribal court authority, subject to federal oversight. The interplay between tribal court jurisdiction and federal administrative probate is complex and varies by tribe.

This is why you need an attorney who specifically understands federal Indian law — not simply a general estate planning attorney licensed in your state.

Why a Standard Will Isn't Enough

A will prepared under your state's laws will control your fee land and most personal assets. But for trust land to pass according to your wishes, your will must:

Specifically identify the trust land and your interest in it
Meet AIPRA's requirements for a valid Indian will (including witness and acknowledgment requirements)
Comply with any applicable tribal requirements if your tribe has its own approved probate code
Be filed with the Bureau of Indian Affairs (BIA)

Wills that don't meet these standards may be treated as if they don't exist for trust land purposes — meaning AIPRA's intestacy rules apply regardless of what the document says.

Steps to Protect Your Trust Land

If you own trust land, take these steps now:

Identify all trust interests. Contact your local BIA office to get a complete listing of your trust land interests, including fractional shares. Many people don't know the full extent of what they own.
